Penny did no different than when an airline passenger has to restrain an unruly threatening passenger on a plane until they land. You hear about it all the time.

There was violence when Neeley was confronted and had to be brought down

The preservation of life is not always justifiable when there are threats

With Neeley dead, the world is a better place

Making threats no matter how ugly they are or what location they’re made does Not justify the use of deadly force.

Penny had no idea what Neely has done in the past and his numerous arrest.

Neely never touched anyone on that train.

Penny took it upon himself to restrain a loud obnoxious man.
He accidentally killed the man in the process.

That’s called manslaughter.

If you pulled out a pistol and shot Neely in the leg so as not to kill him but stop his behavior and he bleeds to death because the bullet hit his femoral artery…..it’s the same thing. You committed manslaughter.

Penny had no legitimate reason to even lay hands on Neely.
If Penny punched Neely in the mouth, and that was it…..it’s still assault and battery.

I assume you would say the same about Justice Thomas, Justice Alito, and the other members of the SCOTUS, who used a similar analogy in questioning counsel during a recent oral argument challenging a Colorado law the criminalizes certain types of threatening speech as violating the 1st Amendment. You are correct.

But unless an unruly airplane passenger dies, it’s not manslaughter.

We are either the party of laws or not.

If someone dies while being restrained on an airplane, it’s manslaughter.

Also, who restrained the unruly passenger? Are they authorized? Did they act without permission from the crew?

Many factors.

When Neely was confronted there was violence, the struggle to subdue Neely began.

Before the confrontation, there was a verbally angry threatening man.

Republicans: “We’re the party of Law and Order.”

Also Republicans: “Mean angry people disturbing our subway ride need to be restrained and if they die, they had it coming.”

I’ve been exposed to a lot of violence as a Detroit Paramedic.
Violence I treated patients from to being attacked myself.

There is a rule of law that should be followed.

Someone behaving badly, yelling on a train but not hurting anyone, doesn’t really worry me.
But some people that haven’t experienced a lot of “City Life” might pee themselves. As we’re observing.

Penny had no idea Neely had a long history of violence and arrest.
Penny was acting based on what he saw at the moment.
What Penny saw did not justify laying hands on Neely at all.

Agreed. These are the same types of snap decisions that LEO must make whenever they make contact with a person behaving badly in a public space. Cursing, spitting, frothing at the mouth, threatening words, pushing and shoving (non-deadly assault on an police officer), and mere resisting arrest are not enough to justify the use of deadly force.

The 'empty cities' paradigm, drive white people out, fill them with the unwashed on the government dole. And that is exactly what we ought to do. Jungle primary, jungle elections? Jungle law.

If any of you live under Alvin Bragg's reign of terror, you are deluding yourselves that you are safe, or worse yet, that "The Bonfire of the Vanities" always happens to someone else.

These kinds of incidents become more prevalent, when the city police force is discouraged from dealing with vagrants and petty crimes like loitering, disturbing the peace, etc. Citizens are forced to deal with it themselves. Giuliani had instituted a policy of dealing strongly with these kinds of crimes, and the effect was a significant drop in violent crime.
