I live out a bit, so a car coming down my driveway is an event. Motion detection goes off and the dog alerts. One came around 4:00AM a few weeks ago. It went down my drive, past the house and back to my barn. When the car turned around and came back, they were looking at me with a rifle pointing at them. They were trying to deliver Uber Eats to my neighbor’s 16 yo daughter. Driver stopped and apologized. I sent them to the next driveway.
Come on. "Pointing" it at them? Ego problems? Uber? You watch too many hollywood movies.
According to Nolo.com, in order for someone to commit an act of criminal trespass, the individual must be on your property without permission and must also be aware of this fact. For example, if someone accidentally wanders onto your property while hiking along a nearby trail, you may not be legally justified if you point your gun at the person.
You overreacted. You are lucky they didn’t call the law out on you.
I get that all the time, had to order another address sign and put it so they could see it on the garage so no more uber eats deliveries thankfully.
You pointing a rifle at the occupants of the car granted them complete justification to, had they been armed, shoot you DRT. It would have been justified self defense.
There you go....preparing for a threat isn’t the same as actively engaging as though everything is a lethal threat.
I have a 500’ long private “road” (old feed road for the farm) off a busy Farm to Market (FM) road that leads to my house. It’s about 400’ long, a 90 degree turn, and another 100’ to my house.
I keep the front porch light on, have cameras, and motion sensing lights on the side and back. And, I’ve had dogs for the entire time.
I’ve had some “yutes” come down my driveway late at night over the past 20 years, but never more than once and not in years.
I guess word got around about the guy who’d meet you at the side/back porch with his hand behind his back. No one ever made the turn, they’d just stop, look, and back right up the entire 400’.
