Not to belittle the poor victimized homeowner here, but it’s amazing how many people are stupid enough to go answer the door in the middle of the night. This isn’t 1975 any more, we don’t have to go answer the door in person; answering the door in person is a great way for someone to shoot through the door while you’re looking through the peephole or advertising your location by speaking through the door.

Me, I’m sitting back in my bedroom, defensive shotgun ready to go and using *my phone-operated external camera system with two way audio* to address whoever is out there. People outside the house have no idea where I am or if I’m even at home. They won’t be able to shoot through the front door and hit me because I’m not there. I won’t have opened the door and thus given anyone with ill intent (badge or not) the opportunity to do me harm or barge inside.

Camera systems are cheap and easy to use. I’m not going to deliver myself to someone violently banging on my door just to see what’s going on.

police are NOT the judge and jury....they should never ever be making situations worse by not using proper tactics, overreacting, impulsive, arrogant...

these cases make it impossible to fully back the police....

Well, if it's the cops ya never know. It could be a fire and their waking up homeowners for evacuation, could be pursuit of a felon which stopped 2 doors down from your house and your home is now within the search perimeter, they could be bringing news of a death in the family, or they could be seeing smoke emanating from your own home... who knows....

Probably a 2nd degree murder charge since it was not a premeditated killing. New Mexico has no qualified immunity... none. you are making a famous error. It is known as the curse of Lew Wallace, territorial governor and author of Ben Hur which he wrote while Territorial Governor.

Lew Wallace.

The curse works both directions. Whatever happens elsewhere, it is not a predictor for New Mexico.

Great! Talk to the camera.

Cops are used to talking to Ring and Blink doorbell/camera units these days. But none of the situations you mention are unable to be taken care of (at least initially) by a camera with two way audio. No reason to answer the door in person until you have established who it is and why they’re there via your camera system.

Either they were so hyped up on adrenaline and playing soldier that they couldn’t hear or think, or they knew damn well they were at the wrong address but didn’t care — they just felt like scaring the hell out of innocent people.

No matter the reason, they should all be charged with 2D murder.

I understand that in NM qualified immunity was done away with. Hooray for NM!! And I agree that they should be charged with 2nd degree murder, but cops always seem to avoid the consequences of their actions. I’d like to wait and see what they’re actually charged with, and if they’re convicted or there is a plea bargain down to some lesser charge.

You understand cameras have their limitations? They have blind spots, wireless cams can be hacked, wired cams can be compromised, they often do not detect for numerous reasons and some have lag times, they can be affected by weather/power issues, etc...Furthermore, bad guys nowadays are emboldened and most don’t care about cameras, and they wear masks, hoods etc. Also, not everyone can afford these systems.

Btw, I too have audio/video cams as well as other security assets, so I understand what they can or cannot do. Bottom line, someone banging on your door in the middle of the night might be there trying to save your life, warn you etc. Ya never know.

You say the cops came to your house at 1:00 a.m. and banged on your door regarding a non-priority call they received at 8:00 p.m. (5 hour earlier) the previous day, regarding a noise complaint on you? And you all had a good laugh and wished everyone good night?

Tell me, are you suggesting the homeowner in THIS CASE knew they were police, but decided to open the door with gun in hand anyway?

And is it possible the homeowner did not know they were cops outside when he opened the door?

I’m not evading squat. The police bust in on people all the time and shoot them and they’re the wrong people. That’s not evasive it’s pertinent.
