A Surprise Accusation Bolsters a Risky Case Against Trump

WASHINGTON — The unsealed indictment against former President Donald Trump on Tuesday laid out an unexpected accusation that bolstered what many legal experts have described as an otherwise risky and novel case: Prosecutors claim he falsified business records in part for a plan to deceive state tax authorities.

For weeks, observers have wondered about the exact charges Manhattan District Attorney Alvin Bragg would bring. Accusing Trump of bookkeeping fraud to conceal campaign finance violations, many believed, could raise significant legal challenges. That accusation turned out to be a major part of Bragg’s theory — but not all of it.

“Pundits have been speculating that Trump would be charged with lying about the hush-money payments to illegally affect an election, and that theory rests on controversial legal issues and could be hard to prove,” said Rebecca Roiphe, a New York Law School professor and former state prosecutor.

“It turns out the indictment also includes a claim that Trump falsified records to commit a state tax crime,” she continued. “That’s a much simpler charge that avoids the potential pitfalls.”

Still, Bragg emphasized that at this stage, prosecutors did not need to go into detail about what other crimes they believe Trump intended to commit.

Bragg will eventually have to show his hand. Barry Kamins, a retired New York Supreme Court judge who is now in private practice, said the next phase of the case would require prosecutors to divulge more.

“What is going to happen now is that the prosecutors are obligated to disclose things in discovery,” he said. “Defense counsel will learn in discovery the nature of the elections laws violations and the tax issues that were raised by Mr. Bragg in his statement of facts.”

As I understand it, the payments in question occurred AFTER President Trump resigned from some 400 companies and was sitting in the Oval Office. Exactly how could the President enter or be accountable for the alleged false accounting entries into a New York based company that he had already resigned from? And what makes these alleged accounting entries false and a felony? Because the DA claims they are Federal Election Law violation, where he has no justification. And, exactly how could this have anything to do with election law since they occurred many months AFTER the election?

This is level of corrupt would embarrass a real banana republic.

I heard he resigned from all the Trump firms too. This is a bookkeeping matter with no underlying “crime”. The DA should be disbarred, and the “Judge” should toss this crap out the window.

The indictment states that Trump’s “fraudulent” intent was to protect his image for the 2016 election. His intent, even if everything the DA says is true, was not to defraud NY tax authorities. BS case.

If Stormy or Cohen didn’t pay the taxes on the money received, thats on them, not Trump.

I suppose they are claiming the personal legal fees were claimed as expenses on his 2017 taxes.

I know nothing about NY tax rules, but I am going to assume his tax lawyers are smarter than that.

Ah, but the statute of limitations would apply to any Obama violations. Bragg is saying that since Trump left (fled?) NY the statute of limitations was suspended in his case.

And, being a Light Worker and God of All Things, Obama can do no wrong in any case.

I read the indictment, and this charge is high comedy.

The indictment says the Trump Organization paid Cohen “attorney fees”, which were TAXABLE at a combined 50% rate (State, local and Federal). They paid Cohen over $400K for the $130K HELOC he took to pay Stormy for the NDA (which, after all, is a legal document).

So Yahoo and NYT says that Trump conspired to defraud NY State in taxes...by paying Cohen in a way that was taxable.

It’s moronic. Not that the libs won’t eat it up with a spoon.

Democrats are strong adherents of Alinsky. Their motives are hidden. It’s very possible the charges are not their end game and they are counting on Trump to say “inflammatory” things about the charges. Then either some Trump supporters will commit violence, or if none do, they the will stage some violent responses and blame Trump supporters. They want to start a civil war.

How in hell can there be an indictment that does not state precisely what crime the defendant is being indicted for? The NYT is desperately trying to keep the sham alive, but the corpse of this case is already rotten.

Turns out the whole reason Donald Trump ran for president the first time was to evade taxes in NY state and then flee the state to avoid being arrested. The act of him running for 2024 is obstruction of justice. He’s going down big time. THIS TIME we’ve finally got ‘em. He’s toast. /s
