The way the grand jury (GJ) process works today, the GJ is at the mercy of whatever the DA chooses to present to them as evidence of probable cause to arrest and charge. No rules of evidence, no defense challenge, no judge, all secret.

A lousy, phony, or corrupt indictment is most likely the work of a flawed DA, not the GJ itself. I don’t know what the GJ process was when the Constitution was ratified, but I doubt it was anything like it is today.

“You could get a GJ to indict a ham sandwich.”

Fortunately there is another process called “Preliminary Exam” (PE) that can be set instead of a GJ. The PE does require the rules of evidence, both parties present evidence and argue, and there is a judge. PE is a much better way to challenge probable cause than the GJ IMO.
