Uh Oh: Florida Law Could Prevent Ron DeSantis From Running for President

According to a report, sources close to Florida Gov. Ron DeSantis say that privately he has indicated he plans to run for the GOP nomination for president in 2024. But, despite his intentions, a Florida law could complicate things for him.

DeSantis has certainly been following the playbook of a potential presidential candidate, including writing a book and traveling across the country, particularly to key states on the primary schedule. He plans to visit Iowa on Friday and then Nevada on Saturday.

DeSantis is expected to make his announcement following the end of the legislative session in May.

Though publicly noncommittal, privately, sources say his presidential candidacy for the upcoming election is inevitable. But state law might require him to resign as governor first. The so-called Resign-to-Run law requires state officials to resign from office before running for president of the United States.

The state legislative session started this week, but a bill that would clarify the Resign-to-Run law’s intentions is not on the docket, which could be a problem for DeSantis. Political experts in Florida say the time to clarify what the bill deems as qualifying for a presidential run is now, before the end of the current legislative session.

The law has been changed twice in the past. First, back in 2007, it was changed by then-governor Charlie Crist, who was looking to be a vice-presidential running mate. That worked out splendidly for him. However, it was changed again back in 2018 when former governor Rick Scott made the bill more restrictive and required state officeholders from seeking federal office without resigning first.

He is waiting for the state legislature to change the law. They’ll do it at the 11th hour at the end of the session then leave for the summer so they don’t have to answer any questions. DeSantis just got re-elected, promised to serve the people of Fla. then gets his state reps to change the law so he can “serve” the people while he spends 2 years out of state looking for a better job. What a sleaze.

Nonsense?
Following what desantis swore an oath to do is what a good leader woukd do. Instead he is trying to please himself, and just using those he swore to be governor for. If he cannot keep his word/oath he is not worthy of any job representing people in any capacity. (Just because plenty of others doing it too doesnt make it ok)

You’ve summed it up perfectly. Deep State neocon DeSantis is a wolf in sheep’s clothing, in addition to being a sleaze. But he’s the current hero of the anti-Trumpers.

It's quite common for sitting senators and governors to run for POTUS while serving.

It's also quite common to consider the potential for running, test the waters, write books, and make the decision and then the announcement at the most opportune times.

Wise waiting, careful timing, certainly not "sleeze".

And, one highly suspects that the good people of the Great State of Florida are excited at the possibility of their popular governor doing well in the big race.

So what did DeSantis have to say about the Florida Republicans putting forth regulations requiring bloggers to register with their state and disclose their personal financial dealings? Why hasn’t he responded to this fascist legislation, or is he in support of it? On his book tour he evaded and panicked when asked about Ukraine. He’s about to ruin his future political career if he runs against Trump, which is probably just as well.

Who’s going to enforce this law in the instance you are citing?

A reasonable statutory construction permits the man to run. If he decides to run, he will rely on that construction, or another reasonable construction, provided to him in the form of a lawyer’s legal opinion. In such a circumstance, he won’t look back, and it is unlikely that anyone who believes in the narrow negative construction will even have/demonstrate standing, much less win a legal battle. We already have federal standards for who can run and hold the office of POTUS, as spelled out in the Constitution. No need for a state to seek to add to those requirements.
