Well, I will concede that determining the MOTIVE will be difficult.
Does it Matter? Well here’s the other concession I will make... The end result is STILL death, pain and suffering regarless of motive.
But in western law, MOTIVE is taken into account. The punishment for accidentally killing a pedestrian while driving vs. deliberately ramming a car onto the pedestrian to kill him is different.
For example: On the night of November 6, 1963, two days after her 17th birthday, Laura Welch ( now Mrs. Laura Bush ) ran a stop sign and struck another car, killing its driver. The victim was her close friend and classmate Michael Dutton Douglas.
Did she go to jail ? What was her punishment?
Now, consider this other case, On November 21, 2021, Darrell E. Brooks Jr. deliberately drove a sport utility vehicle (SUV) through the annual Christmas parade in Waukesha, Wisconsin, United States, killing six people and injuring sixty-two others.
In both cases, people died. But I’m sure, if you were a juror, you would mete out different degrees of punishment in these two different cases.
