Conservative pundit Ann Coulter is under fire for a racist tirade against new Republican presidential candidate Nikki Haley.
In an appearance on the "The Mark Simone Show" podcast this week, Coulter made several xenophobic comments about Haley, the former governor of South Carolina who was born in the U.S. to Indian immigrant parents. "Why don't you go back to your own country?" Coulter said.
Coulter, known for her racist and anti-immigrant stances, attacked India, as well.

Haley was born Nimrata Nikki Randhawa to immigrant Indian Punjabi Sikh parents at Bamberg County Hospital in Bamberg, South Carolina. Her father, Ajit Singh Randhawa, and her mother, Raj Kaur Randhawa, immigrated to the United States from Amritsar District, Punjab, India. Her father was formerly a professor at Punjab Agricultural University, and her mother received her law degree from the University of Delhi. Haley was known under her middle name, a Punjabi name, from her earliest years.
Everything that I am about to say is predicated on whether or not BOTH of her parents were naturalized as US citizens before her birth. I believe that was NOT the case with Haley’s parents.
The following is from the Indian Citizenship Act of 1955:
Citizenship by descent: “Every person born outside India shall be a citizen of India by descent if both the parents or either of them is an Indian citizen, not being an illegal migrant, provided his/her birth is registered at an Indian Mission/Post abroad within one year of the birth.”
This would mean that Haley was born a citizen of India at her birth. This is similar to the citizenship of most every nation on the planet, including the US, wherein any person born to any US citizen ANYWHERE in the world is also a “citizen at birth” by virtue of our Immigration and Naturalization Act.
I believe that the purpose of Article II, section 2, clause 5 was to minimize the likelihood of undue foreign influence on the office of POTUS, PARTICULARLY from a father owing allegiance to a foreign sovereignty. The act of US naturalization requires one to formally renounce all such allegiances.
Wong Kim Ark was the subject of an 1898 SCOTUS ruling involving citizenship. The court held that Wong Kim Ark was a CITIZEN (not a natural born one) by virtue of the 14th amendment, noting that his Chinese citizen parents were lawfully resident within the US at the time of his birth, and completely self supporting.
The 14th amendment was ratified in 1868. It did not exist at the time that Article II was ratified in 1787. The 14th amendment does NOT refer to, or alter the meaning of Article II in ANY way, whatever one thinks that the framers meant for Article II to accomplish.
Haley’s birth status seems to be identical to Wong Kim Ark. She was born in SC to two lawfully resident non citizen parents. She is a “citizen at birth” by virtue of the 14th amendment. I believe that Indian law make her a citizen of that country too, as does US law under the Immigration and Naturalization Act which makes a person born to ANY US citizen ANYWHERE in the world a US citizen.
It strains credulity to think that the framers of Article II, section one, clause 5 in 1787, INTENDED that at any time in the future, absent an amendment to allow for same, that a foreign citizen by birth would be eligible for the office of POTUS and VPOTUS.
None of the framers or founders were NBC. Most of them were born British subjects. They had to establish a grandfather clause by way of Article II, Section one, clause 5 to qualify themselves for the office of POTUS, since NONE of them met that requirement.
Our citizenship laws are similar to theirs. Our laws no more invalidate theirs then theirs do ours. It is a well recognized and mutually accepted international principle to allow mutual recognition for such laws.
How is the anchor baby Hayley, Kamala Harris (also born an Indian national) and Obama more “privileged” then the framers were, who were mostly born British subjects?
The SCOTUS has never directly ruled on what constitutes an Article II Natural born Citizen. But in the SCOTUS Venus Merchantman case of 1814, Justice Livingstone, a member of the founding generation; writing for the majority quoted in it’s entirety the whole 212th paragraph from Emmerich De Vattel’s Law of Nations, (at the time the most widely accepted treatise on international law) which held that a natural born citizen has TWO citizen parents and is born on the soil of the nation AT THE TIME OF BIRTH.
Our overlords have decided that this is not an issue worth examining by adjudication.
I see no downside in attempting, no matter how forlorn the hope, to have this matter adjudicated by SCOTUS or an Article III court and to request an adjudication as to what constitutes and defines an Article II NBC.
No constitutional provision should be considered as optional.
The victim card is important in politics you have to get people thinking you have enemies coming after you to get sympathy-support.
BTW I got three texts pitching financial support for Nikki Haley this week.

‘Nimrata Nikki Randhawa’ (Nikki Haley) may be American but she grew up Sikh... also gave her children Punjabi first names. ....Some have said she converted to Methoist for political purposes as understanding her whole career has been stair-climbing, and becoming a Methodist was just one of those stairs.
If her parents were not citizens at the time of her birth, then she is an Anchor baby and not eligible, just like Kamala. Neither one should be President. Natural born means parents are citizens. It’s in the Constitution, but who the hell cares about that anymore!

People born here whose parents are foreigners (not US Citizens through birth to a citizen or naturalization) are NOT US citizens. They are citizens of the country their parents are from.

Neither of Haley’s parents were citizens when she was born in the US - they were foreigners here as guests of the United States of America. Same with Kameltoe Harris and Marco Rubio.
She is a natural born citizen…. Of India.
