If it turns out to be any such thing, then this was a murder pure and simple. He wasn't "resisting arrest," he was trying to escape men who had already decided to hurt or kill him, and he knew it.
What do you think would have happened to him if he had immediately allowed himself to be placed in the prone position and had his wrists cuffed? Why did he think resisting arrest and then running off was going to make the situation any better at the beginning?
