In the Missouri case, Carnahan died before the election took place. What we're discussing here is what happens if the election occurs, but then the Senator-elect steps down?
The Missouri case was wrong in so many ways:
- Absentee ballots had already be sent out with Carnahan's name on it.
- Votes had already been cast.
- The Democrats insisted that votes for Carnahan be considered as votes for a generic Democrat who would replace him.
- Republicans insisted that the Constitution requires that a Senator must be a resident of the state, and a dead man cannot be a resident so a vote for Carnahan is a spoiled vote. We vote for individuals, not the party that run the individual.
- The state allowed the posthumous win, and the Governor appointed his wife to serve until the next federal election.

These matters always redounds to the discredit of the media who should be fairly recording events and holding the sleazy cheaters accountable, per the letter of the law and per common decency.
