Federal Rule of Criminal Procedure 45(g)&(h) is the vehicle. The basis is the 4th Amendment.

Once you a a defendant, you can start filing motions pursuant to Fed Rule of Criminal Procedure 12(b)(3)(A,B,and C). For example Rule 12(b)(3)(A)(iv) provides for a motion regarding selective or vindictive prosecution.

12(b)(3)(C) provides for the motion to suppress evidence.
