This case has nothing to do with the 1st.

The government’s not a party to the suit and the 1st Amendment doesn’t protect anyone making defamatory statements about another private person.

Besides, he gave up his right to make a free speech defense when he refused to produce the required information to the court.

Who gets the punitive damages? The government I suppose.

The punitive damages are awarded to the plaintiffs. In many cases like this the lawyers for the plaintiffs take on the lawsuit as a way to make money. They agree to take the case to trial and split the winnings with the plaintiffs.

This kind of case is an example of how lawyers make money.

Jones could have won the defamation case in court if he had made any kind of effort.

That is what doesn't make any sense. He could have raised all kinds of issues, and argued that everything he says on the air is just his opinion, even if it may be phrased like it is a factual statement. In effect his show is a kind of performance.

He also could have cited the lack of any homicides in that month in that area of Connecticut on the FBI database of crimes as a basis for his opinions or even conjecture not being entirely unfounded or malicious.

He could also have argued that our nation has seen many things believed to be factually true by the media and the public turn out to be false - like the entire story of supposed Russian collusion by President Trump. So in the context of that, and the lack of any official federal records of the deaths at the time his opinions were protected.

Why he failed to defend the case is a real mystery.

I'm not defending Jones' opinion or statements, which seem like wild speculation at best, just citing some possible ways counsel could have defended his on the air statements, or settled the matter.

This IS NOT solely about Alex Jones. If it were I still wouldn’t like the
Implications, because I believe it is about other targets not as fitting.

Churches, anti-abortion protesters, and others.

That’s who is next > IMO.

Well if memory serves me most of these Parents were Liberal. If memory serves these Parents turned this horrible incident into a anti 2A clown show by inviting everyone from Obama, Plugs Biden and the whole Democrat cast of Clowns and Media and made it into a real clownfest live and in Technicolor. they had clown cars, dancing dogs and skunks. All these evil clowns were fighting for microphone and TV time all the while running guns and anyone who own guns into the ground...Jones didn’t do anything worse than they did..

Don't worry too much. I don't know of a single church, ever, who when notified that children were shot and killled en masse, turned around with a ludicrous conspiracy theory against the parents affected, and sold ads as they grieved.

I wouldn't lose sleep over the churches.

No, it’s more about the churches being taken to task for
talking down abortion. All it takes is a Washington, D.C.
jury and churches and church groups to be place on the hot
seat and judged to pay tens of millions of dollars for
not being understanding or some such.

Evidently this judge down in Texas hasn’t too concerned about
being impartial, and that’s Texas.

At any rate, I’m not losing sleep over it.

100% with you in the hope that courts do not enforce coercive policies on churches or individuals in most cases. I just think Alex Jones is way outside the lines.

Doubtful. He's facing civil suits in Connecticut, which doesn't cap damages. He might want to start settlement negotiations now.
