It doesn't take an expert to read the 12th Amendment: "The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.." Nowhere in there or in 3 U.S. Code § 15 is the power for the vice president to decide what votes to accept outlined.

If the Constitution is meaningless then why not have Trump just ignore January 6th and announce he is remaining in office. Cut out Congress, the Electoral College, and Pence entirely?
