Actually they tried such an idea in SoCal in the late 40s, early 50s. They parked a gambling ship right outside the 12-mile limit (it might have been 3-mile limit back then). Local DA got around it by going after the water taxis that hauled the gamblers out to ship.

That doctor has been blinded by ideology and greed. Willful abortion (premedicated killing of a nascent human being) is STILL legal in California. The doctor wants to profit from the monetary proceeds from gestational persons from other states
Legal question. If the boat is within territorial waters of a state or u.s.a, could the doctor still be guilty of violating the law of the state( if the state outlaws abortion)?. It’s easier for gestational persons to migrate to a state where the gruesome act is allowed instead of some “back alley” boat.

Good luck getting a Federal Court or jury to enforce the Mann Act for a New York resident who travels to Nevada for some bunny ranch time. NYS has ZERO jurisdiction in Nevada and the Federal supremacy clause takes precedence in all matters between States as does the 14th and 9th amendments.

The argument that a NYS resident who pays another NYS resident to travel to Nevada for the purpose of sex is still not going to be prosecuteable in NYS as the alleged “crime” occurred in Nevada completely out of NYS jurisdiction. There is no crime in Nevada as solicitation outside of Clark County is legal. If solicitation happens inside Clark County that is 100% a Nevada jurisdiction. NYS doesn’t own it’s residence they are free people once outside NYS borders that state is powerless as it should be. There is a slew of Federal law and court precedence backing that.

California tries to tax its citizens in other states it only wins for income sourced for activities wholly inside California same for NYC & NYS they went after the Don for it and lost.

State jurisdiction ends at their borders which is 3 miles off their shores in ocean waters BTW. From three to twelve nautical miles it’s 100% Federal jurisdiction and the Fed supremacy clause takes precedence in those waters. Federal jurisdiction ends at 12 miles and then since the USA is a LOS party we have 200 mile economic exclusion zones agreed upon with treaty to the other LOS signatories only economic and environmental codes are enforceable in the 200 nm EEZ per the treaty. Federal legal jurisdiction stops at 12 miles per USC code. The U.S. Fed gov can also claim supremacy territorial supremacy in the contiguous zone from the TSB boundary at 12 nautical miles and the edge of the contiguous zone at 24 nautical miles. This is supremacy between nations and international law the Fed has automatic supremacy over the States from three miles out.

On a US flagged ship USC code follows that ship into international waters if a ship is foreign flagged their laws apply on that ship in international waters. All ships must be flagged or they will be declared stateless and rouge subject to piracy laws under the LOS treaty the apprehending military vessel then uses its military laws to deal with said pirates.
