I would side with the minority on this one, based on a first reading.
As far as I can tell. being charged by the state the crime was committed in, and then being charged by the Federal government is actually two different crimes.
The state has its own law and the Fed has a different law.
I think this could be easily abused and a real government answerable to the people would try to fix it, but the Rodney King trial shows what the Feds really will do.
I think this got messy because an indian tribe was involved

Easily fixed. If a state can prosecute, the feds should not. Eliminate any federal law that is already covered by state laws or jurisdictions.

So, you could be accused of the same crime by your local HOA, township, county, city, state, the feds, a couple of whatever fed and state taxing districts, etc. all for the same crime of jaywalking?

I think there should be coordination between the two sovereigns. Either the Feds prosecute or the state prosecutes but not both.
Save thing with civil courts vs Criminal courts. When it involves a crime, I don’t think there should be a lower standard for civil action than criminal action. No conviction for the crime should me no civil action.

This was a monumentally stupid ruling, especially since it came from two different departments of the same federal government.
Even allowing it for state vs local is bad.

The constitution did not differentiate between Federal and State crime. It simply said you can not endure double jeopardy.
I do understand prosecution under Federal Law and State Law. It should be one or the either and not both.
The USA has become a giant prosecutorial nightmare that deserves to be dismantled and burned in a tribal fire . Financing the court machine and the attendant goons required to enable it will help destroy this once great nation . I can’t understand why they want to destroy America but maybe we can rebuild something better . If we the people win . I am afraid that I would have voted for the minority also. Too damn much gov interference in our lives . Gonna’ put some shiny 20 “ chrome rims on that machine with this ruling .

This was a very bad decision.
It could wreak havoc with first and second amendment rights.

Sadly, you can always depend upon the ‘conservative’ members to side with the State in instances like this.
What does this do to “immunity”? If offered immunity from prosecution for what you admit at a state level when you could still be prosecuted in another jurisdiction, why accept the offer of immunity?
As I recall, Linda Tripp was prosecuted in Maryland for something she testified to and was given immunity for in Virginia.
First in state court, then in federal court.
