In response to the 80 pages of proposed legislation, I give to you 1 sentence:

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

Enhanced background checks for people 18 to 21

Should have stuck in a amendment to 21 for voting.

It is only fair, no right to firearms, no right to vote.

This isn’t a gun safety bill... It’s 80 pages of comedy, political expediency and authoritarian BS.

More redundancy laws that do nothing but further hamstring/frustrate those who buy guns for self defense and protection against socialist anti-American idiot totalitarian communist legislators who want to disarm the citizenry and trash the constitution with a 1000 cuts of overreaching unconstitutional useless regulation.

The communists want to overthrow the Constitution by suffocating it with laws that make criminals out of anyone who dares to embrace its protections and exercise the rights it guarantees! Laws that encourage criminal behavior but punish those who obey the laws. Criminals are protected, while the innocent go to jail.

This one is interesting:

The legislation would suspend a person’s right to buy or possess a firearm for a period of at least five years if he or she is convicted of a misdemeanor crime of violence against a person with whom they have or have had a romantic relationship.

A current or former romantic partner would automatically regain the right to buy or own a firearm after a period of five years has elapsed from the end of their criminal sentence. Romantic or intimate partners who are convicted of a violent crime during that five-year waiting period would not automatically regain the right to buy or own a gun.

Can this be dialed up to the current domestic violence prohibition? Making it a five-year prohibition as well, instead of the current lifetime prohibition? Probably not but I'd sure like to see it.

They don’t enforce the laws already on the books. Hunter is still walking around free as a bird.

It’s surprising that it’s only 80 pages. Most legislation these days weighs in at a hefty 1000+ pages once it is loaded down with pork and unrelated agenda items that can’t get passed any other way.

This will require new background checks on everyone that buys a gun to make sure that you didn’t do anything wrong before you turned 18.

You better hope the records from 40-50 years ago are correct and up to date because they could be used to deny you a gun purchase.

Did everyone think this crap will only effect those 18-20 first time gun buyers? Dumbasses! This will effect EVERY gun sale from this time going forward.

It will take a lot of time to check old records from 50,60, 70 years ago.

While it is not everything we want, this legislation is urgently needed,” Schumer said in a statement...

Of course it isn't. Thanks for saying it out loud.

I'll wait for others to look at the bill and comment.
Early conclusions are often wrong.

Notice that The Hill never provides the actual name or number of the bill, or a link to the text so that people can read it for themselves.

See the comment section is still defunked, too.

but won’t affect the gun rights of law-abiding citizens.

Yeah...bs.

Red flag laws are an assault on law-abiding citizens.
Just wait for the stories about how thanks to red flag laws so many individuals have their rights taken away. For no reason.

Thank my 2 NC Senators for selling us out.

A-holes.

Ok, here's the weasel words that will continue to allow red flag laws to basically be a confiscation program:

"the right to be represented by counsel at no expense to the government";

"The heightened evidentiary standards and proof under such programs must, at all appropriate phases to prevent any violation of any constitutional right"

"penalties for abuse of the program"

https://www.murphy.senate.gov/imo/media/doc/bipartisan_safer_communities_act_text.pdf

It seems obivous that you'd be allowed to have your own attorney, but I'm interpreting the representation line to also mean that you would not be able to have a public defender.

The "appropriate" phase will be applied to hearings. This already occurs for the parts of the red flag laws that actually have hearings before confiscation.

But the problem occurs when they consider it an "emergency". In that case , the seizure can occur simply with a cop "believing" there is a problem, i.e. ex-girlfriend knows the guy gets sloshed on friday night at home so calls the cops because she is concerned he may be "suicidal".

Cops show up and see, yup, he's drunk. They immediately go to the court for the emergency warrant. Since it's night, there is no judge, only a magistrate that will rubber stamp it.

No "penalties" are specified, nor are the "Abuses", hence, there will be NO COST AT ALL against the ex and cops in the scenario above.
