In New Jersey (and probably in lots of other "blue" states) that is "brandishing" a weapon and will get you jail time.

No jail time. Who are they going to believe? A young black punk assaulting an innocent old man sitting on a bench waiting for the wife? I don't think you understand what "brandishing" means.
