No charge will be filed. That's silly. Various definitions of brandishing follow:
Brandishing - display or exhibition of a dangerous weapon, with the intent to use, intimidate, or threaten another person without justification.
Note “without justification”.
“To wave or flourish in a menacing, defiant, or excited way.”

“to shake or wave (something, such as a weapon) menacingly.”
Note “Menacingly”.
“Brandishing is one thing, but aiming is the ultimate brandishing,”
Note “aiming it”.
“to draw or exhibit the weapon in a threatening manner, or to use it in a fight, other than in self-defense.”
Note “threatening manner” and “other than in self-defense”.
In this state self defense is treated as unjustified.
“Shoot, skedaddle and shut up.”
The guy was in a lose lose situation. Shoot and go to jail for life, or keep walking and hope they just want your wallet.
Sorry, I didn't mean to be harsh, but I'm not going to be a pushover. Sorry about living in New Jersey, almost as bad here in California (perps that assault and kill are let off with probation to do it again).
As an old guy, I'll do what it takes to fight back. I've been assaulted as a young man, and won't lie down and not use self defense, consequences be damned. If it's illegal to carry tools to defend yourself, and wrong to defend yourself, and criminals are not punished, then the laws and the system is broken. So be it.
