Congress has exercised a lot of powers that aren't enumerated in the Constitution. It should be a state issue, but I suspect this Court will let Congress address it if it chooses.

In any case, until SCOTUS is squarely faced with the issue of whether Congress can address it, it will be an issue in Congressional elections.

The decision was posted last evening and the part I read indicated the matter should properly be left to the States to decide.
