An interesting dilemma for Biden. On the one hand this ruling should be overturned on appeal without too much trouble. On the other hand they are appealing an order striking down an increasing unpopular government mandate. I suspect that they’ll let the CDC end the mask mandate in the near future while the appeal is ongoing and hope it’s a win/win.
Another aspect of this is that a district court judge is striking it down nation wide, which they should not do. But this is the fruit of liberals judge shopping for someone who will write an opinion striking down a statute or regulation nationwide when the liberals approve of striking it down. They can’t then scream, “The judge only has authority in his own judicial district!”
How so?
It's the right, lawful and sensible decision.
No other decision makes sense.
