Straight from the left-leaning Wikipedia:

“The Court holds the power of judicial review, the ability to invalidate a statute for violating a provision of the Constitution. It is also able to strike down presidential directives for violating either the Constitution or statutory law.[3]”

I don’t see “activism” mentioned anywhere in there.

Why do some groups seem to have a disparate impact as a result of equal application of any given law?

It’s right there in the penumbra right next to abortion.
