Your original comment was: “If Alec doesn’t get a prison sentence, the problem is with that court system.” The operative term here is “prison sentence,” which necessitates a court rendering judgment. The DA and defense counsel are “officers of the court,” but they play no part in passing sentence (and impact statements — if allowed — are only to affect the harshness or leniency of a sentence, but a sentence the convicted will get). But, the judge and jury are responsible for sentencing.
But I agree with you that just because one person skates should not mean other persons committing a similar crime should skate, but that’s a political act more than a legal one.
