No. These cases were consolidated in the 6th Circuit.

That’s who has the case now. The next step is SCOTUS.

The ETS ends in May anyway.

Wouldn’t the next step Be an appeal to the full panel, and not just the three judges?

I am not sure why I thought it was consolidated in the 9th circuit. But next step will be a request for en banc review.
