The bubbas would be sleeping at home tonight if they hadn’t brought a shot gun to the party.

The biggest loser here could have went back to a life of crime and partying, if he hadn't charged and then physically attacked a man holding a gun.

Are you saying they did not see him leaving a house that had been burglarized repeatedly, or you just don’t think that is a crime?

The crime being what? Burglary? Nothing was taken and the house was under construction and open to begin with. Trespassing? A misdemeanor under Georgia law so the citizen's arrest law doesn't apply. Arbery took nothing from the construction site and didn't damage anything at the construction site so no, he didn't commit a crime.

When does burglary require someone to take something? Burglary is entering a location with the intent of committing a crime. And people most certainly can make citizen’s arrests for misdemeanors.

Not under the Georgia law in effect at the time. It required the offense to be a felony - Link

Notice the word, intent. Just because he did not find anything to steal, doesn’t mean he did not commit burglary. And that would still apply if he was checking to see what he could come back for later.

So it does appear they may not have had the authority to detain him, but that is not the same and saying he did not commit a crime. Even if it was just trespassing. It was reported they were experiencing a lot of burglaries and the owner of the house had lost thousands of dollars in theft. I don’t intend to guess why a “jogger” would go into a house under construction, but maybe if he had just stopped to explain, instead of charging a guy with a shotgun, he would be alive and they would not be going to prison.

And Ashli Babbitt could have gone home to her family if she didn’t trespass the capitol. I don’t think you’ve wargamed this one out. If this is a good shoot then so is Ashli’s killing. Do we really want to go down that road?

Burglary requires intent. You have yet to show any evidence at all that he intended to steal anything.

But the law required the crime be a felony. Trespassing is a misdemeanor at best.

In his deposition to the police the owner reported that some plywood scraps were stolen and some fishing gear stolen. That's it. And that was early on, before he set up his cameras. So there is no evidence that Arbery was involved.

I don’t intend to guess why a “jogger” would go into a house under construction...

About 10 years ago I bought a piece of property in rural area east of Kansas City. It was an old farm house about 100 years old on five acres of land, part of a farm that had been split and sold to two other farms years and years ago. My father and I basically gutted the building and rebuilt it, rewired it, HVAC, roof, the whole nine yards. At the time I was living in a suburb that had a lot of new construction going on, and as I was out jogging I would frequently stop and go through houses under construction looking for ideas, how they ran their wiring and plumbing, all the rest. So yeah, I can guess why a jogger would go through construction sites.

... but maybe if he had just stopped to explain, instead of charging a guy with a shotgun, he would be alive...

Let's see...truck chases him for a while...tries to cut him off several times before stopping...two armed men accost him blocking any path of escape...one tells him to stop or he'll blow his f*cking head off...yeah, my first conclusion would be they merely wanted to talk, too. </sarcasm>

...and they would not be going to prison.

Arbery's 2018 diagnosis of schizophrenia was excluded at trial (along with the THC positive). Together they foment reversible error Number Two:

Arbery Was Literally “Off His Meds” When He Charged Travis McMichael

"People close to Arbery had been noting his deteriorating mental health condition in the weeks leading up to his death on February 23, 2020, including his probation officer, who in 2018 had ordered a mental health evaluation of Arbery as a result of such concerns.

Arbery, as a result of this mental health evaluation, was diagnosed with schizoaffective disorder, which is often characterized by uncontrolled violence, aggression, and poor impulse control.

...In June 2018 Arbery’s own mother had called 911 to report that Arbery was withholding her car keys from her. She cautioned the 911 dispatcher that Arbery’s mental condition had worsened over time. She also cautioned the responding police officers that Arbery might get violent due to his mental illness if they tried to arrest him.

Arbery was subsequently prescribed psychiatric medication, specifically Zyprexa (olanzapine), in an effort to control his schizoaffective disorder.

Blood tests performed after Arbery’s death indicated absolutely no detectable Zyprexa in his system, meaning he was literally 'off his meds'..."

Do you think it is an attempt when they are 100 yards away? Is that your measure?

Or do you assume anyone within 100 feet is attempting rape?

You then don’t know the history of the area or the state laws

Three men who saw someone running had zero idea if a crime had been committed. They did not witness a crime nor was the first thing they did was to call police saying a crime was being committed

Not all places in the US have reasonable race relations. If the skin color were reversed I would have the same view. These three broke the law. The jury got it right
