Who is Ray Epps and why hasn't he been charged in the Jan. 6 riot at the U.S. Capitol? There are multiple videos that show the Arizona man apparently planning the march and advocating for protesters to breach the Capitol, yet there's no evidence that he ever entered the Capitol building.
Last week, Rep. Thomas Massie (R-Ky) questioned Attorney General Merrick Garland about Epps' role in the Capitol riot during a House oversight hearing. Massie played a video that appears to show Epps provoking protesters to go into the Capitol building and asked if there were "federal agents or assets of the federal government present on January 5th and January 6th." Garland refused to answer, stating that the Department of Justice does not comment on pending investigations.
On "LevinTV," BlazeTV host Mark Levin noted that "there is no pending investigation" of Epps, which is Massie's point.
"[Massie] is asking a simple question about this guy: Ray Epps," Mark said. "Why can't [Garland] just say, 'He's not one of ours ... that's not an FBI guy'?"

Relevancy, and burden on the witness. Each individual defendant is accused of having entered the Capitol illegally, etc.. Even if he says "He, there was this other guy who encouraged me to go in, and I want him to testify", it doesn't make that defendant any less guilty, which is all that would matter in that criminal trial. Also, Epps lives out of state (apparently), so a judge in D.C. isn't going to be inclined to try to force him to testify in D.C..
And hey, I'd love to see the guy have to testify. I just don't see the pro-leftist judge handling these cases go along with it. You could argue entraptment, but that's hard to prove and again, this crappy judge would likely say there is no evidence that he was FBI anyway.
Just being realistic as to why we haven't already seen him called by one of the defendants.
