One Really Stupid Tweet by Biden’s Own Chief of Staff Helped Blow Up His Federal Vaccine Mandate

Move aside, Donald Trump. Biden’s own White House Chief of Staff has tweeted something far more damaging to his administration than the former president ever did.

In case you missed it, President Biden’s unlawful federal vaccine mandate has been getting hammered in the courts. The Biden administration recently suffered a devastating ruling that held the mandate suffered from “grave statutory and constitutional” defects.

In the course of The Fifth District Court of Appeals maintaining its emergency temporary stay of the federal vaccine mandate over the objections of the Biden administration, the court found that the White House’s own chief of staff had a shady reason for supporting the mandate.

The White House Chief of Staff Ron Klain retweeted a message that explains why Biden is coercing employers to mandate their employees to get vaccinated. It was mentioned in a footnote to the 22-page ruling.

‘OSHA doing this vaxx mandate as an emergency workplace safety rule is an ultimate work-around for the Federal govt to require vaccinations,’ MSNBC anchor Stephanie Ruhle initially posted.

Judge Kurt Engelhardt, one of the three-judge panel on the district court, ruled that Klain’s retweet was an “endorsement” of the phrase “work-around.”

The judge added in the court’s opinion that the public interest is “served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions.” Engelhardt seemingly added a veiled reference to Klain’s tweet: “Even, or perhaps particularly, when those decisions frustrate government officials.

The federal appeals court on Friday delivered a serious blow to President Biden’s unlawful federal vaccine mandate. The court’s decision to maintain an emergency stay over the objections of the Biden administration was interpreted by legal analysts as ‘national in scope.’

The court ruled against the Occupational Safety and Health Administration (OSHA) and a number of Biden administration officials. The OSHA regulation mandated that workers in all businesses with 100 or more employees be “fully vaccinated or regularly tested for Covid-19 by Jan. 4.”

The Biden administration exacerbated its unlawful issuance of the mandate by telling employers to ignore the courts.

“People should not wait,” White House Deputy Press Secretary Karine Jean-Pierre told reporters after the court’s initial ruling. “They should continue to move forward and make sure they’re getting their workplace vaccinated.”

The Biden administration clearly does not have the legal authority to issue such a sweeping mandate. Even Biden’s hapless White House Chief of Staff Ron Klain has apparently acknowledged it with one really stupid retweet on Twitter.

When a retweet helps sink national legislation – that’s an all-time “tweet that did not age well.”

“Work around” a cute word meaning ways to do something they know is unconstitutional.

The Democrats have been doing this for decades

I wish I could believe that’s it took. In the meantime, companies are implementing it.

Companies who push these Mengele mandates are showing how much they care for their employees—by treating them like farm animal medical experiments.

The employees should respond with an equal amount of caring and respect.

The exact reason we MUST eliminate unconstitutional/extra-constitutional agencies of the federal government like the EPA, OSHA, Transportation, Education...and so on.

These agencies control Americans by non-legislative means through regulation.

It is imperative we shrink the size and scope of the federal government and return power to the states.

...and get rid of the American Stazi, the IRS, BATF and reign in our intelligence communities.

Blow Up. I guess whoever wrote the headline wanted to be the first to say blow up about Biden’s vaccine mandate. Well guess what? Nothing was blown up. The mandate will be implemented and remain in effect for a long ass time. Nobody reads tweets. Tweets don’t mean anything. They are forgotten as soon as they are posted. The only ones that are remembered are the ones used for canceling people. If you think a Twitter tweet will have an explosive effect on vaccine mandates you are a really big idiot.

You are correct—a lot of the Jews in Poland thought those pretty trains were going to show them some nice scenery in the countryside...

“Does it mean businesses ant force their employees to be vaccinated for now?”

No, it just means the fedgov can’t force businesses to force employees to be vaccinated (excluding federal contractors).

“The mandate will be implemented...”

You may want to read the 5th Circuit Court of Appeals’ stay ruling. They were very explicit about why the mandate is not likely to survive the court challenge for a very long list of reasons.

OK, though so, but wasn’t sure. So basically nothing has changed except for that fact, which faux president windy will likely ingore again, or create some other kind of “workarounds” to “defeat” the federal ruling

EVERYONE in the Jao Bai-din administration behind this illegal OSHA mandate needs to be held criminally liable for fraud. They knew it was unconstitutional and did it anyway.

Well let’s nope that is the case, but again, it’s likely the obiden admin will rework fhe mandate somehow to work around it if it is struck down in court. And don’t forget, .egal scholars were sure that obamacare wasn’t legal, but because of rino Robert’s, it was passed. Lawyers just shook their heads at his “reasoning” for passing it

Ron Klain is stupid and dangerous. He had pushed Gore to the limit to not concede, and after Bush v Gore ended it, Klain became so bellicose he demanded that Gore and Boies ignore SCOTUS and re-plead their Florida case.

Boies had overly focused on litigating pre-cert, when he should have been focused on litigating post-cert and thus had a foothold to overcome the 3USC safe harbor objections that derailed the recount.

As you can see in this NYMag piece, Klain himself scratched a uniform standard in an all-nighter to submit to Florida Supremes as the speartip of his argument to ignore SCOTUS.

ManBearPig and the rest realized Klain rhymes with insane and MBP conceded that evening:

"Bush v. Gore was a muddled opinion, which took some time for Gore’s team to work out on a conference call...One man wanted to keep going, though: Klain. He refused to give up, and spent the night of the decision drawing up legal papers in the hopes that the Florida Supreme Court might establish a uniform standard, thus satisfying the 14th Amendment problem.

Early the next morning, Gore and his lawyers convened for another conference call.

“Then proceeded the most fascinating kind of historic thing that I have ever been witness to,” Tom Goldstein, an appellate attorney who participated in the Bush v. Gore argument, told me a few years ago. “It was the debate and discussion about whether to adhere to the Court’s decision, which was really, really, really interesting. There was a debate back and forth between the people on the call about whether to fight notwithstanding the Supreme Court, and insist that the Court had effectively tinkered with democracy. It was a real conversation. And it was a real conversation that lasted 20 minutes.”

I’d say that if this stay becomes a ruling that they are in trouble and the lawyers will be lining up in droves to sue for wrongful dismissal.

Something about Article VII of something.

I don’t get out much but I hope people are as pissed off as my neighbor thinks they are.

Pretty serious to lose your job over something that is illegal. Wokeness is stupidness.
