Nominated by the new President, confirmed by majority vote in the Senate. We note that in this situation, Ms. Harris would not be in a position to break ties. However, Harris would have to go far off the reservation (she IS part Indian, unlike a certain Senator) to have her nominee rejected.

I was wrong. It’s by majority vote of both Houses of Congress, as some earlier Freepers correctly stated. The President gets to nominate, so whoever Donald J. Trump names (only serious).
