Just got tuned in. Judge say when he would rule on the defense motion yesterday?
No ruling yet.
He said he would put it under advisement.
He won’t have to rule on it when the verdict is not guilty.
Defense made the motion to preserve the issue on appeal if Rittenhouse is somehow found guilty on any charge.
And, if Rittenhouse is found guilty on the most minor charge, the judge could grant this motion for mistrial on that charge. The prosecution isn’t going to retry that case.
