Two problems...
(1) After the Sussmann conversation, Baker immediately phoned the FBI Assistant Director of Counter Espionage. According to the AD's notes, Baker told him that Sussmann "Represents DNC, Clinton Foundation, etc." In other words, Baker knew exactly what clients Sussmann was working for.
(2) The next problem, how did Sussmann interpret Baker's question about speaking on behalf of his clients? I interpret that to mean "Did your clients instruct you to contact the FBI?" There is no evidence that Sussman's clients instructed him to do anything. In fact, there are many reasons to believe that Sussmann sincerely believed Trump had violated the law.
Washington D.C. voted 95%-5% against Trump.
A first year law student could bring in a hung jury on this charge.
