Boebert bill to block Paris climate agreement reignites Senate ratification debate

Rep. Lauren Boebert, Colorado Republican, has introduced a bill to block the Biden administration from reentering the Paris agreement until it receives Senate confirmation, a nod to the longstanding debate over the accord’s legitimacy.

Her bill, which has 11 GOP cosponsors, bars Congress from appropriating funds to implement the international climate accord until it receives Senate ratification, a step that former President Obama skipped when he used his executive authority to enter the agreement in 2016.

“My bill prohibits Congress from spending a single penny on the Paris Agreement until this treaty is ratified by the United States Senate,” said Ms. Boebert in a Thursday press release. “Joe Biden took an oath to uphold the U.S. Constitution. If he wants to keep it, he must transmit the job-killing Paris Agreement to the U.S. Senate for ratification.”

The bill has little chance of passing the Democrat-controlled House, but the legislation has drawn attention to the debate over whether the Paris accord is an executive agreement, as the Obama administration maintained, or a treaty that requires the advice and consent of the Senate under the Constitution.

The only reason Obama used an EO to sign on to Paris was that it would have never passed the Senate. The Kyoto treaty was defeated 95-0 in the Senate.

Trump could have suspended our participation in the Paris Accords and then had it voted on in the Senate. It would never have passed. It would have made it impossible for Biden to get back in with an EO.

Perhaps you should take a look at the Constitution, which requires 2/3 concurrence to consent to ratify a treaty.

NO way would the Paris Accord, Or the Iran nuclear deal have been passed.

He didn’t have to talk to the Senate. Just issue an EO suspending participation in Paris and then have McConnell put it to a vote in the Senate for ratification. The Senate ratifies treaties. It would never have passed. Treaties require a 2/3 vote for ratification plus the President’s signature.

Where was that your EARLIER point ?

kabar’s point (and mine) in 20 was that PDJT should have sent the ‘agreement’ to the Senate for approval or rejection, which would have driven a stake through its’ heart.
In 25 and since you’ve argued otherwise.

Why would President Trump send a treaty enacted by an Obama EO for approval?

The level of discourse here has dropped badly.

You send a treaty to the Senate for approval. You don’t send a treaty to the Senate to not have it approved.

That makes ZERO sense. A failed Senate vote would change NOTHING.

This thread is one degree from more noise about Cruz, Rubio and others have no constitutional right to run for US President with that same type of weirdness.

SMH.

Wrong.
If President Trump had sent the ‘treaty’ to the Senate for its’ Constitutionally required consent, that would have put a stake through it.
In this case you DO send a treaty to the Senate to have it not approved.

That makes TOTAL sense. A failed Senate vote would change EVERYTHING.

The President has to SEND it to the Senate for consideration and approval or rejection.

You are certainly right; the density here IS running deep. (but in this case probably mere ignorance)

Yeah, go ask a few Senators why they didn’t take up the measure themselves?
Is there a law stopping them from introducing action?
