But what happens if Pence does it anyway? Just declare it so. 10 days should be enough. The only way to stop this is for the Supreme Court to step in.

That’s not going to happen on Jan 6. We should get a few days at least. If the states make the moves we are hoping for quickly the case in front of the Supreme Court would be moot. The Dems would do it in a heartbeat

The date is set by statute. VPOTUS presides and runs the show according to the Twelfth Amendment of the U.S. Constitution. Implicitly, he can delay the vote if he deems it necessary. The law does not over-ride the constitution which places responsibility directly in the hands of the state legislatures. If members of the legislatures claim that they have questions, who is to question them, and only a resolution of the whole legislature should be taken as evidence of the determination of the legislature.
