Since the Fifth Circuit declined Goehmert’s suit—which probably should have been directed at Congress rather than the VP—we will not have an answer on the issue of plenary power for a while. I suppose that if the Governers tie breaker is implemented then there will be a case, but it will only be addressed after the ECA takes place. (I suspect that if overturned that you could not use “Quo Warrento” on the winner.

The actions of the Democrat party have made this a total mess. The cowardice of the Republican have made it worse.

But under existing law the states all turned in their certified list of electors on time.
The governors have no Constitutional power to submit slates of electors for the state.
As I said, the state legislators, the ones that have the Constitutional power, needed more time.
And has been pointed out, the state legislatures delegated the power to select the electoral college slate to the voters and the power to approve those results to state officials. All in accordance with the Constitution.

The Constitution says that the legislators "direct" the electors. It doesn't say that the legislators direct somebody else to direct the electors.
