Georgia Secretary of State and State Election Board Changed Absentee Ballot Signature Verification and Added Drop Boxes Without State Legislature’s Approval

As in-person early voting began Monday for the January 5 run off election for two U.S. Senate seats in Georgia, significant changes for absentee ballot signature verification and drop boxes put into place by Secretary of State Brad Raffensperger and the State Election Board ahead of the November 3 presidential election without the state legislature’s approval are still in place.

Local county registrars began mailing approved absentee ballots to voters for the January 5 run off elections more than three weeks ago on November 18, according to Georgia’s election calendar.

Neither (1) the use of drop boxes for voters to deposit absentee ballots nor (2) the current method of absentee ballot signature verification have been authorized by the Georgia General Assembly.

Mail or personal delivery are the only two ways that Georgia lawmakers have clearly specified in O.C.G.A. 21-2-385 that electors are to get their absentee ballots to the registrar or absentee ballot clerk.

There are no provisions in the current Georgia code made by state legislators – who have the sole constitutional responsibility for setting election procedures as stated in Article II Section I, Paragraph I of the Constitution of the State of Georgia – for drop boxes or any other manner in which absentee ballots can be returned to the registrar other than mail or in-person delivery.

Wow Raffenshiter just violated the Equal Protection Clause. Cobb County votes are now 'elevated' above all other Georgia county votes.

Well, I guess it’s a start...OTOH, it makes me think that since SCOTUS can’t use their “standing” excuse, what excuse will they come up with this time...

Rather than merely “stop” it going forward...

Need to ask relief in segregating ballots depending on source in origin... drop box ballots kept separate by location... mail in ballots kept separate by date and location, etc.

Ample enough evidence of fraud already shown that it makes it important to preserve the patterns that act as evidence.

The governor of Georgia has spoken and we can’t challenge that, no matter how crooked the election was. We have run out of time to act, there will be no Boom moment that will save the day. I felt pretty defeated when Obama was elected twice, now I just feel like I outlived the Republic, too bad for us.

But DID the STATE choose to do that, if it was just the Secretary of State and the State Election Board, and NOT the State legislature?

The governors accepted it and that is all that will be counted no matter how much stink is raised. We are a now an officially lawless country and only the lawless will wield power.

Agreed. I’ll post the link when it’s filed.

His other lawsuit should, in a perfect world, nullify the entire 11/3 election as it was based on Illegal agreements made by the SOS, or in very least, require true signature matching on absentee ballots. That was the bulk of the steal here.

The state legislature did not agree to it, it was a deal made between our SOS and democrats. There were lawsuits about even before the election, Completely illegal.

This whole thing is just a debacle. Kemp and Raffesperger need to be prosecuted. Trump needs to get off the dime real soon and invoke the insurrection act. There needs to perp walks left and right.

Also, of course, Republican observers should be prepared to oversee every element of the election... which, particularly in the case of illegally supplied dropboxes, should mean establishing 24/7 oversight (video surveillance ?) of the boxes and those dropping ballots into them.

Does Georgia allow ballot harvesting ? If not... one person dropping multiple ballots into a box would be a problem. And, how and when are the ballots collected, and by whom, and with what accounting provided ?

I’ll leave it to the locals, given I don’t know Georgia law at all, to figure out how to make it happen in a compliant form... but, clearly, it should include daily requests for the accounting data generated per drop box...

Otherwise... the SCOTUS has already ruled that the laws don’t really matter anyway... and if that’s the rule that now govern elections, that “he who cheats mostest and bestest wins”, I’d expect to see some form of reciprocity being applied... although, obviously, nothing systemic, rather than expecting change that is locally innovative.

If they insist on sustaining the falsehood of elections being fully trustworthy and election fraud being a “myth”... more than one way to skin that cat... or spoil an election... in a way that is compliant with law while it requires an acknowledgement that is paired with a requirement for a “re do” with fraud potential eliminated.

Election fraud... is the new “civil disobedience” ?

Not my choice... but I don’t make the rules... only compete within the rules others impose.

Might be fun to address the issues under the law... if the drop boxes are not legally (legislatively enacted and funded) empowered... then they’re not legal... so, what law DOES apply to them ? Installing other new ones, now... should create a contest on that subject re legitimacy... just by doing it in parallel in a way that is designed to fail ?

Just post stickers on them: “This voter fraud location is under video surveillance” ? “Ballots dropped in this box will not be counted under Georgia law” ? Etc.

Again, I’m not an attorney, and don’t know Georgia law...

But, given the green light... innovation seems required.

Being overt about it...

Needs to be structured in a way that disabling the one disables the other...

So, when urban areas count ballots without envelopes or signatures...

Rural areas need to conduct “practice voting” sessions... intended for teaching people how to fill in mail in ballots... which, when doing that without having any envelopes, ensures they aren’t real... so filling them in isn’t fraud...

But, then, later... when someone discovers a pile of ballots that haven’t been counted... that haven’t had signature checks... ? Should we count every vote... or check signatures ? Without an offsetting penalty the wrong choice is likely to be made... so the offsetting penalty has to be created... without violating the law in the process.

Here are the concerns I have posted before in GA:

Observers will not be able to be close enough to observe.

Observers who raised concerns were kicked out, even with contacting election officials and lawyers. Even emergency lawsuit filings were ruled against the GOP

Absentee ballots were already opened before coming into the counting area

Absentee ballots were adjudicated at locations other than the election centers. Majority of votes were adjudicated election night, as much as 98%

The Coffee county election clerk showed how easy it is during adjudication to switch votes to whomever they wanted, and much of the adjudication was done without GOP oversight.

Witness affidavits to the fact 2 dem teams were allowed to handle adjudication

The signature matching issues the SOS agreed to with the democrats are so cumbersome that it is nearly impossible to validate.

Anyone can get an absentee ballot, no ID required.

Stacy Abrams already has a million absentee ballots ready to go, and apparently ballot harvesting is not illegal in GA.

Give the some 50k illegal voters not being addressed in the 11/3 election, an Obama judge is on the verge of ruling that another 200k purged from the rolls can be added back.

The chain of command is very poor. Dekalb county cannot find their chain of custody for absentee ballots. Fulton County refuses to act on a ballot transfer FOIA until Jan 19, 2021

Other nightmares, the SOS dismissed most claims of fraud despite saying otherwise. I know many people this happened to. Some of them are part of lawsuits.

The SOS did not do a true audit despite saying he did. He did a risk-limiting audit which means putting a few ballots through some machines to show they worked. The SOS chose which machines to test.

The GBI investigation is also controlled by the SOS, any complaints to them are directed back to the SOS.

The recount was a sham, GOP was not allowed any meaningful observation every county that came up with numbers different than the original numbers had their election officials dismissed.

Neither our SOS, Governor, Lt. gov nor AG will undergo any investigation or consider serious challenges to the process, nor will most courts so far in GA. Trump’s lawsuit in state court on 12/4 has not even gotten a hearing date yet.

The SOS made it even easier to cheat in the runoffs, adding more drop boxes and mobile voting units.

We have a handful of GA legislators on the right side, but the rest are either scared of riots/antifa/BLM or were threatened by the Lt. governor.

Another good guy in all of this is the GA GOP Chairman who is fighting tirelessly, and is one of the plaintiff’s in the Trump lawsuit. He was the first to say on Nov 4, his observers were kicked out of State Farm arena.

Bottom line is this, if SCOTUS does not rule in our favor, the insurrection act may be the only remedy here in GA because the corruption has permeated every branch of our state.

I like your idea about monitoring drop boxes, but we had video of people dropping stacks into them. Again, if no one will uphold the law here then what?

One person said to be sure not to put this certain software on a usb drive that might crash the machine, lol

The thing is, if any conservative tried anything, they would be all over it like white on rice. Like they were over proud boys burning a BLM flag, but ignoring BLM rioting and burning entire blocks.

mrs riverdawg and I voted yesterday in the Senate runoff race. Everyone in line filled out and signed a form, photo IDs were required (with one odd exception I will discuss below), a completed paper ballot with QR code (no actual ballot choices are shown on the paper ballot) was printed out and scanned after choices were completed on the Dominion machine, and there was at least one poll watcher present to oversee any disputed eligibility issues. We stood in line for about 20 minutes (10 minutes outside in an unseasonably cold morning).

The odd exception to the photo ID requirement is for first-time voters who initially registered to vote by mail. Voters in that category are not required by law to show a photo ID when they vote in person for some reason. Presumably, there is a required signature match between the mail-in registration form and the form every voter fills in during the in-person voting process. This loophole needs to be closed by the Georgia legislature.

I do think having exposed the machines as wide open to fraud... has already essentially declared an open season for them to be attacked by hackers in the next election.

An important element in combating “error” is mockery.

Make the denial so outrageous no one accepts it by proving it in a way that subjects them to ridicule...

Otherwise, yes... you might need poll watchers to get the wrong ID to get them in... or come up with an alternate form of enforcing the law, to prevent them being kept out... while arresting corrupt officers who obstruct the law by keeping them out.

In many instances I saw... the “cops” keeping watchers out were activists impersonating officers. Be prepared for that. Get lists... from the cops... of the officers authorized to watch the polls... ensure each of them is informed what the law requires before time... and ensure each of them knows they’ll be held personally accountable for “errors” in obstruction. Then, have the lawyers there... to accuse and serve them. Once they’re served... get them removed. And, follow through. Get them fired.

Part of the consent decree between Stacey Abrams and the SOS was that only one person (rather than two, as before) is required to verify a signature that is in dispute. This, along with the location of poll watchers, needs to be fixed by the Georgia legislature.

I think the answer to that is... create new reasons that they have to uphold the law... by structuring challenges that operate against them if they don’t.

Can’t be more specific... because I’m not there to see what the weaknesses of their approach are. But, you find out the weaknesses and then exploit them.

If they trucks loaded with “particular” ballots in the back door without proper security ?

What else might they take in the back door that exposes the problem in unexpected ways ?

Can you sneak in ballots that say “this is a fraudulent ballot”... in some form that isn’t overly obvious, but is clearly identifiable, later ?

Can you get a judge, somewhere, to approve an effort in “testing” the systems for fraud... to show they’re able to exclude frauds... fully expecting they won’t ?

The law always has holes in it... and the expectation of good faith is often misplaced. Find the holes... that don’t help them... and exploit them ? Can’t say what that means without knowing what weaknesses exist in the law ?
