Thats the point: the decisions re: the election in the rogue states were not legal.

OTH, and I hate to say this but am going to toss it out for consideration: Governors emergency powers have been upheld everywhere....so much so that they are not even seriously challenged. Those powers were granted by the legislatures. Could their argument be that these changes were made because of the PANDEMIC pursuant to the exercise of emergency powers already given?

Congress itself cannot pass unconstitutional laws!
(Well, they can but they can be overruled!)

In Marbury v. Madison the Supreme Court announced for the first time the principle that a court may declare an act of Congress void if it is inconsistent with the Constitution.

So if congress can't pass mandates or laws which conflict with the constitution .. how would that not apply to any Emergency Power Mandates by a governor?

These Unconstitutional laws/restrictions are allowed to stand because .. the American people have 'surrendered' their freedom to their Masters!

What happened was unconstitutional. The Gubners were required to have the legislatures change the rules. All the commies need in the future to take our guns is to declare an emergency (Katrina where the police/sheriffs took people’s firearms, house to house). Doesn’t matter what emergency they want to use.
