Correct. They do not but they have already accepted the states’ case for review. Now they have to determine whether they will grant Trump’s motion to intervene. The reality is if this were a 5 to 4 liberal court and Trump was the Dem standard bearer, they would grant his motion to intervene regardless of the law. Republican SC judges have a tendency to try to adhere to the law. That is why it is not a sure thing with Republican SC judges as it would be with Dem judges.
