That would be the prerogative of a private business.

That's not correct. Look at the mask "decrees." Businesses (including grocery stores) post signs that the wearing of the mask is dictated by "Executive Order." Some signs even say it is the "Law" - even though no laws were passed.

Who said anything about a law being passed and enforced?

A private business can require that customers show their card or wear a mask.

2020 confirmed the case law that judges can change laws. They did it with Covid and they did it with the election.
