The 1934 Act itself is unConstitutional. It became unConstitutional when the tax became unpayable and made an entire generation of firearms "illegal" for Citizens to buy.

Further, when the BATFE was just a tax collection agency, they had a claim to legitimacy through said Act. Once they were moved to the FBI from the IRS, they lost even that marginal legitimacy.

Both the CGA of '68 and the FOPA of '84 are equally as illegitimate as they both contain BLATANT infringements that have been allowed to stand.

Even the SCOTUS' cowardice has limited their response to the ongoing abuse to two marginal "gun victories" in the Heller decision and the Miller decision before it. Even then, rather that just upholding "shall not be infringed", they used extremely limiting language to avoid doing their job and in Miller kicking it back to a lower court where the plaintiffs had actually DIED and were no longer able to respond.

This is incorrect. The 1934 NFA tax applied to ALL SBR, SBS, machine guns, suppressors, etc. Before the 1986 ban, it was common for people to register NFA weapons that their relatives had liberated during WWII.

Not from what I have seen. Adding firearms which were not in the system was always dicey, after the 1968 amnesty.

What is needed is another amnesty.
