That’s the right cutoff time. We’re having a huge issue in PA about late ballots. Hopefully the Supreme Court or the legislature steps in.
At this point the opinion of family and friends and everyone else doesn’t mean anything..... All that matters is the opinion of the Supreme Court.... Either they do right by the voters or they screw us
No, family and friends equals perception and popular support. This will come down to the appetite of stat a legislators to buck thr “vote”. It most of their constituents feel like the vote is not representative of their will it’ll make it a pill the legislators can swallow. Elections are as much political as law in this case
Regarding the Supreme Court, it voted 4 to 4 with regard to allowing late votes. So, the people you cite are 50-50 on the matter.
I will lay out the argument: the Constitution gives the power to the legislature to determine the process. This is not an unqualified power, as the legislature must adhere to Constitutional protections, state as well as federal, and to federal law. Courts, state as well as federal, have the power to fill in grey areas of the law and to resolve disputes in the law.
This year, in Pennsylvania and elsewhere, courts have inserted themselves into the process, to change the process; e.g., to allow mail ballots to be received after election day when the law is explicit on this; to relax the requirement for a postmark and for the signature to match the voter file, and to allow the Governor to send out unsolicited ballots. Furthermore, the requirement in the law for election observers within six feet of election workers was disobeyed in the face of a court order.
With a vacancy, the Court deadlocked on the matter of the deadline for receipt prior to the election. That vacancy has been filled. Furthermore, there is evidence of irregularities and fraud (at least to some extent), demonstrating the need for safeguards and arguing that the process really should be determined by the legislature and not by judges.
I am sure the Supreme Court would prefer that its decision in the case of Pennsylvania will be made irrelevant to this year’s election by the outcomes elsewhere in the country.
ALL ballots received after Election Day will be tossed!!
