IANAL but I suspect that one has to be able to claim an injury and give notice to the alleged defendant before filing a complaint action in court. in addition, technically the courts do not open before business hours of the locality in question. so if true then nothing substantial could have been done legally overnight in terms of filing.

Also the really bad stuff imho did not start until the MI and WI mystery votes from heaven at 4:00AM this morning.

for all i know, 4:00AM local time might be within the optimal time period to pull off this type of white collar fraud and maximize delay in getting filings to the court clerks.
