I know. It's a doomsday scenario, but one the Democrats would do in a scorched earth tactic.

The GOP legislature will try to seat their own slate of Electors, and the Democrats will go to court to block it until the safe harbor date passes. Maybe Roberts will see the light and rule for the legislature, maybe not.

If SCOTUS rules for the legislature, then the 20 EV will go to President Trump and he will win.

Thing is, the Constitution explicitly says that the appointment of a state’s electors is in the hands of the legislature. The Constitution does not even require an popular-vote election for President. Don’t see how SCOTUS can vote against a legislature appointing its Electors.
