I believe is does, as written in the 25th Amendment. If the new VP (Harris) and Pelosi's new committee deem Joe incapable, he's gone (as may have previously been suggested.....Joe, you're a placeholder)
Or not. Joe may finally realize they're serious about this 'placeholder' role and he prefers not to go down in history with a stain such as this.
You do understand that this will NEVER be law- Trump won’t sign it and Harris won’t be able to, and if you think Pelosi would try to sign her own law-— you have no idea the level of hot shite will be visited upon her. As in— unprotectable physical danger. That and being incompetent all on her own.
But let’s not speculate prematurely. They may all lose their minds just in time.
You need to read the whole amendment.
If the VP and either a majority of the cabinet or some other body deemed by Congress (Pelosi's new commission) declare Biden incapable, Biden has the opportunity to object.
If Biden objects, the original players have to override Biden's objection by appealing to Congress to decide. Then it goes to Congress where both chambers must attain a 2/3rds vote to override Biden and remove him.
This is where the scenario breaks down. Unless Biden is comatose or stroked out, we have to assume he fights it. If he fights it, I don't believe there are enough Republicans to join Democrats in putting Harris in the Presidency.
