Thank you for looking this Colorado law up, which even further makes my case, which is very clear cut this is murder. In order to claim self defense, there are many considerations and NONE of them fit what happened here.
You’re welcome. I live in NY State, and have no idea what the laws on the use of pepper spray is. Knowing Cuomo, it’s probably banned. After viewing the photo of the victim and the shooter, it hit me that I should check the State laws to see how they dealt with its use. Since it’s considered a non-lethal defense tool, there was no legal reason for the shooter to fire his weapon.
