Why did he pepper spray a guy pointing a gun at him? It still is murder, but who would not consider it an escalation. Gunman can claim the spray made his trigger finger involuntarily jerk.
Assume you dont have a firearm and someone is already pointing a gun at you. If he pulls the trigger, your dead. I believe it is best to try and make him miss. While pepper spray is not the best option, it may have been his ONLY option.
Spray an move, hope the guy gets enough of a dose that he cant see and it messes with his aim. Again, not much of a choice but it may have been his only option.
Actually, the pepper spray started after the gun came out, kind of a defensive reaction. I am pretty sure the man saw the gun, totally did not expect it, his hands probably started reacting on their own. If you notice the other hand, it has started into his chest as a protective measure, and he is taking a step away from the guy.
Totally unprepared for the gun to come out, and trying to distance himself. But the shooter knew what he was doing and hit him with a head-shot, no attempt at shooting the can out of his hands. The shooter meant to kill.
Unless he pulled the gun before the spray was deployed. You have to have a legit reason to pull your gun. Personal fear and angst are not a good reason. Cops get in trouble if their first reaction to an unarmed individual is to pull a weapon. Trained security are taught only pull the gun if you plan to use it. If this security guard pulled his weapon before there was any threat he deserves a charge of manslaughter. The reporter who instigated the confront had big balls because he brought armed security. He needs to be charged as well.
“Gunman can claim the spray made his trigger finger involuntarily jerk.”
I think there’s a good chance that’s what happened.
1. Improper finger placement on the trigger.
2. Involuntary reaction to the spray, perhaps the trigger was set light and basically he had an accidental discharge.
Might get him down to manslaughter or similar charge. Anything seen about the “second gun” that was in an early report?
With a head shot"
We couldn’t see what happened off camera but one must assume he was defending himself. In Colorado, the use of pepper spray is considered a legal and non- lethal form of self defense.
I understand what you’re saying about escalation however.
Lee Keltner had the can of pepper spray in his hand while he was arguing with the other Antifa jerk a few moments before he walked away from the argument and was intentionally shot dead through his eye. He didn't spray that jerk even when he was taunted to do so. He only sprayed pepper spray as a reflex after he was shot. The photographic evidence proves that.
