In Texas if a homicide has occurred which is by definition one human killing another by violence , negligent actions or willful disregard for safety. The homicide is ALWAYS reviewed by a grand jury in this state the DA does not have the discretion to issue the no bill that power SOLELY rests with a grand jury of your peers as it should. You do not want a individual DA or prosecutor having the sole power to indict or not. Know this if you cause the death of a person in Texas you will be before a grand jury at the minimum.
