The special prosecutor assigned to investigate the handling of the Jussie Smollett case says Chicagos top prosecutor, Kim Foxx, engaged in substantial abuses in letting the actor go free.
The [Office of the Special Prosecutor] did develop evidence that establishes substantial abuses of discretion and operational failures by the [Cook County States Attorneys Office] in prosecuting and resolving the Initial Smollett Case, wrote Dan Webb — who was tapped by Chicago Judge Michael Toomin to re-probe the case — in a statement Monday.
Shortly after the Chicago Police Department found Smollett allegedly faked a hate crime against himself and threw him in jail, the charges against the former “Empire” TV star were suddenly dropped by Foxxs office — a move that raised questions about ethical misdeeds and illegal actions.
Toomin then ruled the case was rife with unprecedented irregularities and assigned Webb, a private lawyer, to re-probe the case and determine whether Smollett deserved fresh charges and if Foxx acted improperly or illegally.
Smollett was slapped with new charges earlier this year, but the investigation into Foxx didnt wrap up until Monday, Webb said.
His office found that Foxx didn’t do anything illegal but said there were five instances of abuse committed by her office, including dropping the charges without cause, making misleading and dishonest statements to the public and speaking with Smolletts family members in the midst of a criminal investigation.
