.........Flimsy Counterintelligence or Flimsy Criminal Investigation?

One more aspect of the charge filed by U.S. Attorney Durham is intriguing. He describes the Bureau’s Trump-Russia probe as a criminal investigation from the start:

On July 31, 2016, the FBI opened a Foreign Agents Registration Act (“FARA”) investigation known as Crossfire Hurricane into whether individual(s) associated with the Donald Trump for President Campaign were witting of and/or coordinating activities with the Russian government.

Yet, when then FBI director James Comey (quite stunningly) acknowledged the investigation in March 2017 public testimony before the House Intelligence Committee, he described it as a counterintelligence investigation:

What they did is not just illegal, but SEDITIOUS, and if the Demonrats could do THIS pre and post the 2016 election, it should totally nullify any complaints they have about the Barr/Durham investigation being done too close to this election!

That’s a great question. I have a couple thoughts. First, a FARA probably doesn’t warrant to date with the FISA court. A FARA investigation should follow ordinary criminal warrant processes in front of a regular judge and not get access to intrusive surveillance techniques and two hops which was what they were really after to get to Trump.

Second, counter-intelligence is meant to inform the President of foreign threats. And the president would normally be advised along the way and sign off on the surveillance.

Advising the president about a criminal investigation would seem to be a no no if you listen to the media hacks.

This guy's guilty plea almost certainly means he's cooperating with Durham. That would mean that he's giving names, dates, places concerning his peers and/or superiors in the conspiracy. It's my understanding that that's the way prosecutors sometimes work when investigating conspiracies and criminal enterprises...catch someone of middle (or lower rank) and offer him a deal...two years in prison for cooperating, fifteen years for refusal to cooperate.

At least 99% the person will cooperate.

Probably depends on how much time he’s looking at and how much he values his law license (cause he will probably lose that when the Bar gets around to a hearing).

... because the Media and the courts automatically gave/give the Obama administration the benefit of every doubt. Most stories you read in the major papers and listen to on CNN/MSNBC read like press releases. On top of that, every fact-checking organization will automatically declare every statement/speculation as FALSE if it goes against one of those stories.

You can have a functioning democracy without a free-exchange of ideas.
