Article III, Section 3, Clause 1. Look it up. Yes let's do look that up. "Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort." The Confederate states did not levy war against them (ie the states of the US). It was exactly the reverse. They were at peace and then they were attacked by the Lincoln administration.
