The judge in Michael Flynn’s criminal case asked a federal appeals court Thursday to reconsider its ruling last month ordering him to dismiss the prosecution of the former national security advisor to President Donald Trump.
Judge Emmet Sullivan’s lawyer asked for a so-called en banc review of the decision of the appeals court, which would involve all active judges on the court to re-hear the case.

I suppose as long as Sullivan doesn't give voice to his feelings from the bench, there's no proof of that.

If Trump loses, he still has months in which he could just pardon Flynn.
Legal, maybe. Ethical, no.
I think Sullivan has gone round the bend and cannot let go.

This will give weight to the demand that the case be given to another judge.

Sullivan has been assured by a majority that they will take it up and rule in his favor. Roberts won’t let SCOTUS take it up, so Sullivan will be back in the driver’s seat.
