What do you think of the separate Thomas/Alito opinion?
Thomas/Gorsuch opinion
Dang, I’m working (at lunch) but now you have me concerned...I have to look
I got nervous about this on two counts:
First, I thought...what am I doing agreeing with Kagan? I cannot think of a single big issue I would side with her on...is there something here I don't see, a deeper thing that a seemingly good decision simply is a front by Leftist Activists in Black Robes to hide a hidden back door opening for something completely destructive and corrosive to the Republic?
Secondly, I thought that with Justices Thomas and Alito, that they were going to highlight that hidden back door, an opening of penumbras and such, but instead I got the impression (on the basis of the few pages I read) that they were strictly adhering to what was in the Constitution, but were basically saying that if states wanted to allow their electors to vote as they pleased, it was up to them to allow it.
Am I wrong there????
