In Texas it's after sunset, then force can be used. But that's criminal statues.

That statute applies to theft or vandalism. In Texas, deadly force can be used anytime, day or night, to thwart murder, rape, robbery, arson, kidnapping, or burglary.

Burglary doesn't just refer to a private residence but includes business establishments, motor vehicles, boats, and aircraft.

Correct. Mr. Horn in Houston was cleared after he shot someone he’d observed breaking into his neighbor’s house one afternoon. He was on the phone with police and went onto his porch to confront the burglars when they exited the house. They charged at him and he shot.

This happened a few years ago, so my memory is a bit foggy on the details. Pretty sure it was two burglars.
